We Killed Your Daughter; You're Under Arrest


Killer's buddies assault the relative of a victim

Daniel Hiler ran out of gas during an evening motorcycle ride in Oildale, California on December 16. While walking his bike to a gas station, the twenty-year-old father of two ran into a family friend named Chrystal Jolley. The pair was crossing a street at a widely-recognized intersection when they were fatally blindsided by a vehicle traveling at a speed well in excess of the posted speed limit. Despite the fact that darkness had descended, the driver hadn’t turned on his headlights. The victims were killed instantly.

Within minutes, police swarmed the scene, and arrests were made — none of which involved the driver, Deputy John Swearengin of the Kern County Sheriff’s Office. The four people arrested were relatives of the victims, who got into what the Sheriff’s Office described as an “altercation” with California Highway Patrol officers when they attempted to identify the victims.

"I was at home on Friday night working on my car when someone came running over and told me that a deputy ran over my daughter in the street,” recalls Jimmy Clevenger, Jolley’s father. “I ran down here, I was very upset…. The next thing I know, they had me by the neck and threw me to the ground and said I resisted arrest. My daughter was dead in the street and it was their fault.”

The outraged relatives were taken to jail, and face criminal charges. Swearengin, the killer, was taken to the hospital and wasn’t compelled to undergo drug or alcohol screening

The posted local speed limit (for Mundanes, of course) is 45 miles per hour.  According to several on-scene accounts from horrified witnesses, Swearengin blew through the intersection at a speed of 75–90 miles per hour. Despite the fact that he was obviously in a hurry, Swearengin didn’t activate his siren or running lights — or, according to at least one eyewitness, his headlights.

Sheriff Donny Youngblood told the Bakersfield Californian that the deputy “was responding to a report of a stolen vehicle with a suspect still at the scene” when he struck his victims. This would mean that he was not involved in a high-speed pursuit. Furthermore, as some skeptical witnesses pointed out, the main office of the Sheriff’s Department is about a mile or two west of the intersection where Swearengin killed Hiler and Jolley — and he was headed that direction at the time of the incident. This suggests that the deputy wasn’t motivated by an urgent call from an isolated and over-matched comrade, but rather engaging in a favorite pastime of uniformed adolescents — “Kickin’ ass and drivin’ fast.”

Some residents of Oildale, a suburb of Bakersfield, describe the Kern County Sheriff’s Deputies as notorious for their habit of speeding through the town’s narrow streets, blithely ignoring speed limits without bothering to activate their lights or sirens.

“They have no consideration for the other public,” objects Michelle Cameron, a distant relative of Jolley. Her assessment is seconded by Forrest Faulkner, an 11-year resident of Oildale who claims to know and be on good terms with most of the department. “They’re great people,” Faulkner maintains, even as he criticizes the department’s habit of putting the public at risk by needlessly reckless driving. “I’ve seen sparks fly from the car’s undercarriage when they hit a dip,” Faulkner recounts.

Under section 192 [c][2] of California state law, the deaths of Hiler and Jolley resulted from an act of vehicular homicide -- one involving “gross negligence,” and therefore a felony. No charges have been filed against Swearengin, and the deputy faces only an “administrative” inquiry, rather than a criminal investigation.  The outcome of the administrative procedure isn’t exactly shrouded in mystery.

“What gets me is we already know the outcome,” complained Anna Rodriguez, one of Hiler’s friends, to a local reporter. “The officer will go on paid suspension. Then they will say he didn’t do anything wrong. And that will be the end of it.”

  2. such a terrible thing for the victims and the families, only to be magnified by the actions of them not only being arrested, but knowing that nothing is being done that could possibly bring this so some type of closure. while I don't think charges and or conviction are closure perhaps it might be a good place to start. my condolences to the family and friends of the victims. my sincere wish the officer will not sell his soul, come forward with the truth and face the consequences.

    What's been happening, countrywide (even, in Eur.) is that the pig cops (apologies to the 4-leggeds)have been killing people right and left. Do you remember the case of the little girl sleeping in her living room, when the pigs knocked her door down, and shot her several times? It was obvious, to me, then).

    The cop-pigs intend to cause widespread riots, to hv the excuse to call down martial law, bring in the goon military-mercenaries-UN-NATO troops (NATO is now in the U.S., too).

    Apparently, they've got their orders from "tp that should NOT be."

    So far, We, THE People, have been orderly and law-abiding...that's the ONLY thing that's held the Feds off.

  5. And even if they sue the city, with the best possible outcome, the city will settle without admitting any wrongdoing; the settlement will be paid by taxpayer money; police union will ensure that not a hair drops from the cops' heads, neither for the murder, nor for the false arrests.

    But then, there's noone to blame for this but the people themselves, because in democracy, it's noone else but them are the ones who elect and reelect their corrupt government. You have the government that not only you deserve, but you elect with your own hands.

  11. In answer to dzinto's comment that we, the citizens of this country voted for the government that now exists - I only wish. There's nothing running that's fit to vote for. There's plenty that most of us would like to vote against, but when you go down to the pole to fill out your ballot, there is no place on that ballot where you can vote no. You can either vote yes for this senseless idiot or yes to that senseless idiot. This is why many people have stopped voting and are looking for another way to express their discontent with the status quo.

    Their heads will literally be on the chopping blocks and the masses will be screaming for the headsman's axe to fall.

    Unfortunately, the one pinning this deal is the very same entity that enabled the guilty and gave them everything they needed to commit their vile "crimes against humanity".

    This falls into perfect alignment with the method that has always been used....

    The "problem" is being revealed to us now.

  23. They need to file lawsuits. if a criminal trial is out, then a civil one should take place. Remember OJ? He had the charges dropped but the lawsuit nailed him. Same applies here. Same state too.

    I went through hell when my wife was run down and killed on her bike. The cops even tried to get me to meet them out in the mkddle of nowhere alone at midnight. AS IF! Advice to the family, start the suit immediately and watch your backs, it'll get nasty before it's over and you may have to move like I did, but it's something you have to do now. God bless.

  24. Mmmmm... no drug or alcohol test for this driver? I'd have thought that would be pretty much mandatory for any vehicle related accident, whether the vehicles in question are driven by police or the public.
    Here in the UK, any drivers involved in a traffic accident are breath tested as a matter of routine and, if it's a bad one, may have to give a blood sample as well at hospital to rule out drug use.
    The fact this officer did not undergo any testing at all stinks quite frankly. Even if clean, he is still guilty of a host of other motoring offences.

  25. My son in law is a police officer, last week a car swerved across two lanes of traffic pulling into a bar, and hit his police cruiser head on. The woman got out of her car and was apparently unhurt. A helicopter arrived and flew her to the hospital where she was examined and released. She was not tested for drugs or alcohol, since the accident occurred at 5 pm.

    My daughter answered the door to see a plain clothed police officer, her worst nightmare, tell her that her husband was in a bad accident and he rushed her to his side with lights flashing and sirens wailing. My daughter is 8 weeks pregnant. It took 45 minutes for his ambulance to arrive and an hour and a half to drive through rush hour traffic to the hospital.

    He laid in extreme pain at the emergency ward unable to be medicated for another 3 hours until his police chief and a county medical examiner could arrive to draw his blood for a drug and alcohol test.

    I am stating this example because all police departments are not corrupt and often swing to the opposite extreme. They said that they will probably just settle out of court with the women and write her a big fat check. When they downloaded the black box on the police cruiser, they noted that it was going less than the posted 35 mph speed limit and he was in the proper lane of traffic.

  26. Well you know the cop's name and address. What's the problem with executing justice when our public servants refuse to? Someone has to do it.

    If the cops flaunt the law and remain immune from prosecution, then it becomes the duty of local citizens to uphold the law. Just go to the cop's house with plenty of rope and do what has to be done. End of story.

  27. An eye for an eye I say. If he was going to fast without headlights he is responsible. A good person would accept responsibilty for their actions in such a situation. The worst part is, nobody accepts responsibilty for their actions. Everyone is trying to get out doing something. Everyone is trying to get away with something. We are all guilty of something. Maybe not as egreegious as this but none of us are innocent. If we dont each change ourselves, instill the best of values in our children and hold each other fully responsible for our actions then it is only going to get worse. May GOD bless us all.   28. Firstly, My deepest condolences to the family(ies) involved. Nothing done or said eases the pain of a loss of that magnitude. Keep your heads firmly attached to your shoulders, seek help from those you love and trust, and continue living as best you can. Remember that the sun rises tomorrow morning and your life must go on.
    Secondly, as noted above, (consult a lawyer that you trust) and file a civil suit against the murderer in question. He should feel the wrath of the law that he is supposed to uphold.

  30. The one thing that i remember the most clearly over the past 39-40 years of my school days at Brandeis University in1970's are my student adviser's words that when he was growing up that his grand parents and parents used the term "‘goyishe kup,’" meaning that the "Non-Jews are Stupid"

    Later in life I learned that the exact translation of "GOYISHE KUP" means that the "Cattle are STUPID"..

    I remember him recalling whatt his father told him when he was growing up in Eastern Europe. One of them being that when his father was in high school he and a group of friends would skip school early on Fridays and go over to his friend's father's butcher shop. That they would buy at cost any cows , that had not been butchered by the end of the day on Friday before the begining of shabat . They would take the cow home and wash it and then the boys would procede to "beat the udders of the cows so that they would swell up and turn pink" so as to sell them to the "GOYISHE KUP" as milk producing cows.

    The part that I remember him asking me if the East Europeans are so naive, so gullible and so stupid to buy old "non milk producing cows" from a bunch of young Jewish Boys.

    So thinking of it now I agree with the Jewish saying that the "GOYISHE KUP" are indeed" Stupid" as they believe that a Bunch of Arab Muslim Kids who were not able to Fly a Cessna Airplane took it upon themselves to FLY a Boing Jumbo Jet outwitting the US Military and Civilian authorities. The "Jewish Lightning Insurance Scam" of the 1960's is still alive and well has been put to good use by Larry Silverstein and his SAINIM Jews in putting 15 million down and comming out with 7 billion dollars for buidings that no one wanted to buy because it would have cost a billion dollars to remove the asbestos from.     The Iowa caucus is only a few days away and the nation's attention will be directed to the results, which signify the beginning of the U.S. presidential race. But does anyone watch who tallies the results of the Iowa caucus?

    The Iowa caucus results were tallied in 2004 by a company that is headed by a man whose company was bought by Elron Electronics, the Israeli defense firm. I suspect that it will be the same this year. Don't expect to see any grassroots political activists doing the tally in Iowa. The Israeli defense establishment takes care of that part of the American "democratic" election process.
